1. Agreement

These terms are between you and GreenVine Cloud LLC ("we", "us"). By downloading or using Keepsake you agree to them. If you do not agree, please do not use the app.

Keepsake is distributed through Apple's App Store, so Apple's Licensed Application End User License Agreement also applies. Where these terms and Apple's EULA genuinely conflict, Apple's EULA governs the distribution of the app; these terms govern everything else.

2. Who may use Keepsake

You must be old enough to hold an Apple Account in your country. Keepsake is not directed at children under 13.

3. Your licence

We grant you a personal, non-exclusive, non-transferable licence to use Keepsake on the Apple devices you own or control, as permitted by Apple's rules.

You may not: reverse engineer, decompile or disassemble the app except where the law expressly allows it; rent, lease, lend, sell or sublicense it; or remove any proprietary notices.

4. Keepsake Pro

Keepsake is free to use, with limits on some features. Keepsake Pro is a one-time purchase that removes those limits.

5. Your recipes are yours

You own what you put into Keepsake. We claim no rights over your recipes, photos or notes. We do not have a copy of them (see the Privacy Policy), so there is nothing for us to license, publish, or use for anything.

Keepsake stores what you enter verbatim. It does not rewrite your words, and it does not alter a recipe's text to suit the app's own style.

Recipes you import from elsewhere

When you import a recipe from a website, that content belongs to whoever published it. Keepsake keeps it for your personal use and records the source so the page can be credited and reopened.

Keepsake has no sharing, publishing or redistribution features, and that is deliberate. You are responsible for using imported content lawfully, which in practice means: keeping it to yourself.

6. Acceptable use

Do not use Keepsake to break the law, to infringe anyone's copyright, or to interfere with the app's operation or other people's use of it.

7. Recipes are not advice

Keepsake is a place to keep recipes. It is not a source of nutritional, dietary, medical or food- safety advice.

Recipes in your cookbook — whether you typed them, scanned them or imported them — have not been reviewed by us for safety, accuracy, allergens or suitability for any diet or condition. Cooking times, temperatures and ingredient quantities are whatever the recipe says.

Where Keepsake scales a recipe's quantities, adjusts a serving count, or reads a recipe from a photograph, it is doing arithmetic and text recognition — not judging whether the result is safe or sensible. Check the result before you cook it. You cook at your own risk, and you are responsible for food safety, for allergen checks, and for anything you serve to others.

8. Availability

We aim to keep Keepsake working, but we do not promise it will be uninterrupted or error-free. It depends on Apple's platforms and services — including iCloud and the App Store — which we do not control.

We may change or discontinue features. If a change would remove something you paid for, we will say so in the release notes.

9. Disclaimer of warranties

To the fullest extent the law allows, Keepsake is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Some jurisdictions do not allow the exclusion of implied warranties, so this may not apply to you.

10. Limitation of liability

To the fullest extent the law allows, GreenVine Cloud LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, or the cost of substitute services.

Our total liability to you for any claim relating to Keepsake is limited to the greater of the amount you paid for it or US$100.

Some jurisdictions do not allow certain limitations of liability, so parts of this may not apply to you. Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud.

11. Your data, and backups

Your cookbook lives on your devices and, if you enable it, in your own iCloud account. Keeping backups is your responsibility. Settings → Data → Export Cookbook writes out a backup file at any time, and we recommend using it.

We cannot recover data for you, because we never had it.

12. Termination

You may stop using Keepsake at any time by deleting it. These terms end when you do.

We may end your licence if you materially breach these terms. Sections 5, 7, 9, 10 and 14 survive the end of this agreement.

13. Changes to these terms

We may update these terms. The effective date above will change, and material changes will be noted in the app's release notes. Continuing to use Keepsake after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Courts located in Colorado have exclusive jurisdiction, except where mandatory local consumer-protection law gives you the right to bring a claim where you live — in which case that right is unaffected.

These terms are written in English, and the English version governs.

15. Apple

Apple is not a party to these terms and has no obligation to provide support for Keepsake. Apple is a third-party beneficiary of these terms and may enforce them against you. If Keepsake fails to conform to any warranty that cannot be disclaimed, you may notify Apple for a refund of the purchase price; Apple has no other warranty obligation.
